DUI Defense for Driving Under the Influence

The ever-increasing focus on DUI-related accidents and drunk driving has caused many people in Florida to be charged with a DUI offense.  Unfortunately, you may find yourself in this situation and facing serious penalties that could dramatically affect your life. Fortunately, however, with a better understanding of your situation and the help of a Tampa DUI attorney, you could potentially have your charge reduced or dropped.

DUI Offenses and Penalties

As a Tampa DUI attorney will tell you, the repercussions of a DUI conviction will vary considerably based on the unique factors of your situation and charges. The following are some common examples:

  • 1st offense DUI –  up to $1,000 in court costs and fines, 50 hours of community service, up to 1 year of probation, county jail time, DUI school and treatment, and revocation of driver’s license up to 1 year
  • 2nd offense DUI – between $1,000 and $2,000 in court costs and fines, up to 1 year of probation county jail time (mandatory 10 days if offense is within 5 years), DUI school and treatment, and revocation of driver’s license up to 5 years
  • 3rd offense DUI – at least $2,000 in fines, up to 1 year in county jail (mandatory 30 days if offense is within 10 years), up to 1 year of probation, DUI school and treatment, and revocation of driver’s license up to 10 years
  • Felony DUI– charges associated with leaving the scene of an accident, seriously harming or killing someone from an accident, or having three or more DUI offenses in ten years.

Many people convicted of a DUI will also need to install an ignition interlock device for a specified period of time depending on the BAC (blood alcohol content) level. Additional penalties may also be assigned for having a minor in the vehicle in the car at the time of arrest or having a BAC over .15.  No one wants to be saddled with these penalties, and many people accused of a DUI choose to enlist the support of a Tampa DUI attorney like Jim Jenkins.
